Supreme Court Rejects Mexico’s Lawsuit Against U.S. Gun Industry

The U.S. Supreme Court unanimously dismissed Mexico’s 2021 lawsuit against American gun manufacturers, citing the Protection of Lawful Commerce in Arms Act (PLCAA).

Mexico alleged the companies knowingly aided unlawful gun sales fueling cartel violence.

Justice Elena Kagan wrote that the complaint failed to plausibly show the firms aided or abetted criminal activity.

The Court rejected Mexico’s argument for a legal exception, warning it would undermine PLCAA’s protections.

Although U.S. guns are widely trafficked into Mexico, the justices ruled manufacturers aren’t liable for third-party misuse, comparing it to automakers not being responsible for drunk driving incidents involving their cars.
